Terms & Conditions
1. Scope
These General Terms and Conditions apply to all contracts between Herbert Schmidt — Blueprint Sessions & Keynotes, A-5400 Hallein, Austria, herbert@herbertschmidt.at — hereinafter "Provider" — and clients for coaching, consulting and other services offered on this website.
Deviating terms and conditions of the client apply only if their validity has been expressly agreed to in writing.
2. Services
The Provider offers services in the areas of coaching, training, consulting, nutrition coaching and performance coaching. The specific scope of services is determined by the respective description on the website, an individual offer, or a separate agreement. Unless expressly agreed otherwise in writing, no specific result is owed.
3. Conclusion of Contract
The content on this website does not constitute a legally binding offer, but an invitation to make contact. A contract is concluded only by:
- written confirmation of an appointment or offer by the Provider
- an individual agreement between Provider and client
- the actual use of the service following prior arrangement
4. Service Delivery
Services are provided in the agreed format — online via video conference, by phone, by email or in person. The Provider is entitled to reschedule appointments for good cause (e.g. illness, force majeure); in such cases, an alternative appointment will be arranged.
5. Prices and Payment
The prices agreed at the time of contract conclusion in euros, inclusive of applicable VAT, shall apply. Unless otherwise agreed, payment is made by bank transfer upon invoice. Invoices are due within 14 days of the invoice date without deduction.
6. Appointments, Cancellation and No-show
Agreed appointments are binding. Free cancellation or rescheduling is possible up to 24 hours before the agreed appointment. For later cancellations or no-shows, the agreed fee may be charged in full or in part, unless a demonstrably important reason exists.
7. Client Obligations
The client is responsible for the technical requirements for online appointments (stable internet connection, suitable device) and undertakes to communicate all information relevant to the service in a timely manner.
8. Health Responsibility
Services are provided within the scope of coaching and consulting. They do not replace medical, psychotherapeutic, physiotherapeutic or other health professional treatment. Any existing complaints, illnesses, injuries or other health limitations must be disclosed prior to commencement. No guarantee of healing is given.
9. Right of Withdrawal for Consumers
If the client is a consumer and the contract is concluded exclusively by means of distance communication, a statutory right of withdrawal of 14 days from the conclusion of the contract generally applies. The withdrawal must be directed to herbert@herbertschmidt.at.
10. Liability
The Provider is liable for damages only in cases of intent and gross negligence. In the event of a breach of material contractual obligations, the Provider is also liable for slight negligence, but only for the typically foreseeable damage, to the extent permitted by law. Liability for damages to life, body or health remains unaffected.
11. Copyright
All content, documents, concepts, texts, plans and PDFs provided by the Provider are protected by copyright. They may be used exclusively for personal use and may not be reproduced or shared without express written consent.
12. Governing Law and Jurisdiction
Austrian law applies. The place of jurisdiction is, to the extent permitted by law, the registered office of the Provider. For contracts with consumers abroad, mandatory protective provisions of the respective country of residence remain unaffected.
13. Severability
Should individual provisions of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall not be affected.
